– The therapist is required to act in accordance with legal regulations. The rights and obligations of the client and care provider are laid down in, among other things, the Medical Treatment Agreement Act (WGBO) and the Quality, Complaints and Disputes Care Act (Wkkgz).

– The therapist who works with children under the age of 16 concludes a written treatment agreement with both parents, provided that they both have parental authority.

– The therapist keeps a client file. The client has the right to inspect his own file. The file is stored for a total of 15 years in accordance with the legal retention period.

– The therapist undertakes to provide information regarding the treatment to the client at all stages of the treatment. The client undertakes to provide the therapist with relevant information through the intake interview.

– The therapist maintains confidentiality with regard to the information provided by the client. However, with the exception of the data on which the client has stated that he / she does not object to the use for statistical purposes.

– The therapist may not perform certain treatments without the client’s consent.

– The therapist undertakes to refer the client correctly to a colleague therapist or a doctor if her / his treatment is inappropriate and / or adequate.

– The treatment can be terminated at any time by mutual consent.
If the person requesting assistance no longer appreciates the continuation of the agreement or considers it necessary, he / she may terminate it unilaterally. If the person requesting the therapist terminates the agreement against the therapist’s advice, the person requesting the therapist will sign a statement stating that he has prematurely terminated the research or treatment against the therapist’s advice in the investigation or treatment.
The therapist can only unilaterally terminate the agreement stating arguments if it cannot reasonably be expected of him / her to continue the agreement. The therapist will continue to provide help and advice in such a situation, until the person asking for help can conclude an agreement with another care provider.

– The client agrees with the rate of € 85 per consultation.

– Payment method for the treatments is per pin / on account / cash per consultation.

– The client undertakes to cancel an appointment in time (at least 24 hours in advance), otherwise the costs of the reserved time may be charged.

– For complaints about the treatment, the client can turn to the secretariat of the Association for Iokai Shiatsu Therapists (www.iokai-shiatsu.org). The client then has the choice of whether he / she has the complaint within the V.I.S. wants to discuss with a confidential counselor, or wants to turn to a complaints officer of SCAG, a national dispute settlement body for complementary and alternative care. If a complaint cannot be handled as desired, the complaint will be submitted to the SCAG disputes committee. For disciplinary law, the client can turn to the TCZ Foundation, Disciplinary Complementary Care (www.tcz.nu).

– All possible adverse consequences arising from the withholding of information present in the medical file at the GP are for the account and responsibility of the client.

Dispositions concernant la convention de traitement

– Le thérapeute est tenu d’agir conformément aux réglementations légales. Les droits et obligations du client et du prestataire de soins sont définis, entre autres, dans la loi sur les accords de traitement médical (WGBO) et la loi sur la qualité des plaintes et des litiges (Wkkgz).

– Le thérapeute qui travaille avec des enfants de moins de 16 ans conclut un accord de traitement écrit avec les deux parents, à condition que les deux parents aient l’autorité parentale.

– Le thérapeute tient un dossier client. Le client a le droit de consulter son propre dossier. Le fichier est stocké pendant 15 ans au total, conformément à la période de conservation légale.

– Le thérapeute s’engage à fournir des informations sur le traitement au client à toutes les étapes du traitement. Le client s’engage à fournir au thérapeute des informations pertinentes au cours de l’entretien préliminaire.

– Le thérapeute maintient la confidentialité des informations fournies par le client. Cependant, à l’exception des données sur lesquelles le client a déclaré qu’il ne s’opposait pas à l’utilisation à des fins statistiques.

– Le thérapeute ne peut effectuer certains traitements sans le consentement du client.

– Le thérapeute s’engage à diriger correctement le client vers un collègue thérapeute ou un médecin si son traitement est inapproprié et / ou adéquat.

– Le traitement peut être interrompu à tout moment par consentement mutuel.
Si la personne qui demande l’assistance n’apprécie plus le maintien de l’accord ou ne le juge pas nécessaire, elle peut le résilier unilatéralement. Si la personne sollicitant le thérapeute résilie l’accord contre l’avis du thérapeute, elle signera une déclaration indiquant qu’il a mis fin prématurément à la recherche ou au traitement, contre l’avis du thérapeute lors de l’enquête ou du traitement.
Le thérapeute ne peut résilier unilatéralement l’accord en exposant des arguments que si on ne peut raisonnablement s’attendre à ce qu’il / elle maintienne l’accord. Le thérapeute continuera à fournir aide et conseils dans une telle situation, jusqu’à ce que la personne qui demande de l’aide puisse conclure un accord avec un autre fournisseur de soins.

– Le client accepte le tarif de 85 € pour la première consultation avec un entretien d’admission et le montant de 70 € par heure qui suit.

– Le mode de paiement pour les traitements est par broche / sur compte / en espèces par consultation.

– Le client s’engage à annuler un rendez-vous à l’avance (au moins 24 heures à l’avance), faute de quoi les frais de l’heure réservée pourraient être facturés.

– Pour les réclamations concernant le traitement, le client peut s’adresser au secrétariat de l’Association pour les thérapeutes shiatsu Iokai (www.iokai-shiatsu.org). Le client a alors le choix de porter ou non la plainte dans le registre V.I.S. souhaite discuter avec un conseiller confidentiel ou s’adresser à un responsable des plaintes du SCAG, organisme national de règlement des différends, pour des soins de remplacement et des soins de remplacement. Si une plainte ne peut être traitée comme souhaité, elle sera soumise au comité de règlement des litiges du SCAG. Pour le droit disciplinaire, le client peut s’adresser à la Fondation TCZ, Soins complémentaires disciplinaires (www.tcz.nu).

– Toutes les conséquences néfastes possibles de la non-divulgation des informations figurant dans le dossier médical du médecin traitant sont pour le compte et la responsabilité du client.

Bepalingen betreffende de behandelovereenkomst

BEHANDELOVEREENKOMST

 

Het volgende heb ik gelezen:

  • De therapeut is gehouden te handelen conform de wettelijke regelgeving. De rechten en plichten van cliënt en hulpverlener zijn onder meer vastgelegd in de Wet op de Geneeskundige Behandelingsovereenkomst (WGBO) en de Wet kwaliteit, klachten en geschillen zorg (Wkkgz).

 

  • De therapeut houdt een cliëntendossier bij. De cliënt heeft het recht tot inzage in het eigen dossier. Het dossier wordt conform de wettelijke bewaartermijn in totaal 20 jaar bewaard.[1]

 

  • De therapeut verplicht zich informatie betreffende de behandeling te verstrekken aan de cliënt in alle fasen van de behandeling. De cliënt verplicht zich middels het anamnesegesprek relevante informatie aan de therapeut te verstrekken.

 

  • De therapeut betracht geheimhouding ten aanzien van door de cliënt verstrekte gegevens, die in het dossier worden opgeslagen. Maar met uitzondering van de gegevens waaromtrent de cliënt heeft verklaard dat hij/zij geen bezwaar maakt tegen het gebruik voor statistische doeleinden.

 

  • De therapeut mag zonder toestemming van de cliënt geen bepaalde (be-)handelingen verrichten.

 

  • Aanvulling van de informatieplicht van de hulpverlener: het zwaartepunt komt te liggen op het “samen” beslissen over de behandeling met de patiënt/cliënt.

 

  • De therapeut verplicht zich de cliënt correct door te verwijzen naar een collega- therapeut of een arts, indien haar behandeling niet geëigend en/of toereikend is.

 

  • Beëindiging van de behandeling kan te allen tijde met wederzijds goedvinden geschieden. Indien de hulpvrager voortzetting van de overeenkomst niet langer op prijs stelt of nodig acht, kan hij/zij deze eenzijdig beëindigen. Indien de hulpvrager tegen het advies in van de therapeut de overeenkomst beëindigt, zal de hulpvrager op verzoek van de therapeut een verklaring ondertekenen waarin hij te kennen geeft dat hij tegen het advies van de therapeut in het onderzoek of de behandeling voortijdig heeft beëindigd.

 

  • De therapeut kan de overeenkomst slechts eenzijdig onder vermelding van argumenten beëindigen, indien redelijkerwijs niet van hem kan worden gevergd dat hij de overeenkomst voortzet. De therapeut zal in een dergelijke situatie hulp en adviezen blijven verlenen, totdat de hulpvrager een overeenkomst met een andere hulpverlener heeft kunnen sluiten.

 

  • U heeft het privacyreglement van praktijk InnerChoice-Shiatsu gelezen en u stemt in met dit reglement.

 

  • De cliënt gaat akkoord met de tariefstelling van €85.,– (euro) voor het eerste consult met intakegesprek en met het bedrag van €85,– per sessie hierop volgend.

 

  • Betalingswijze van de behandelingen is [per pin, op rekening of contant per consult].

 

  • De cliënt verplicht zich een afspraak tijdig (minimaal 24 uur van tevoren) af te zeggen, anders kunnen de kosten van de gereserveerde tijd in rekening worden gebracht.

 

  • Voor klachten over de behandeling kan de cliënt zich voor het klachtrecht wenden tot de Shiatsu Vereniging Nederland (https://www.shiatsuvereniging.nl/) en voor het tuchtrecht tot de Stichting TCZ, Tuchtrecht Complementaire Zorg (www.tcz.nu).

 

  • Alle eventuele, nadelige gevolgen voortvloeiende uit het achterhouden van informatie aanwezig in het medisch dossier bij de huisarts, zijn voor verantwoordelijkheid en rekening van de cliënt.

 

  • Er bestaat inzagerecht voor nabestaanden.

[1] In een voorbeeld van een beroepsvereniging is hieraan toegevoegd: In uitzondering op de wettelijke bewaartermijn, zullen bij plotseling overlijden van de therapeut de dossiers van de cliënten worden vernietigd.

We weten op dit moment niet of dit wettelijk ook kan. Daarom hebben we deze toevoeging niet in deze behandelovereenkomst opgenomen.
